Our local code enforcement say's that it can't enforce their animal ordinance on bird noises because birds are not considered animals.Even tho their ordinace defines animals,"any living dumb creature. " Am I stupid or what. What is a bird?

Hi. You could ask if a boa constrictor is on their list of animals because you were thinking of getting one. Or a bird eating snake. You should probably base your complaint on the private nuisance aspect of the noise. : http://www.lectlaw.com/def2/n025.htm

I have had a similar argument with our local parks bylaw, which prohibits 'harming or disturbing any animal life' with a fairly substantial fine.

When I pointed out that this makes killing wasps or mosquitoes in the parks technically illegal, they told me it didn't count because 'those aren't animals'. When I told them that they definitely, absolutely were animals, they changed the wording to read 'wildlife', which I later pointed out did not change the problem with the bylaw as the mosquitoes and wasps were wild.

The bottom line is that those who write and enforce bylaws, codes and laws are complete morons, and interpret them how they see fit regardless of how the law is written. It's not that they can't enforce the ordinance. It's just that they couldn't be bothered to do their job.

Lookie here. You prove they're animals yourself!! They're noisy, obnoxious, and rude! I won't even mention that they crap on everything in reach------ANIMALS! Seriously, though, I don;t know what you want code enforcement to do. Are these wild birds? Or neighbor's pets?
While you're scientifically correct that all birds are animals, I don't think that's going to make much headway for you with any governmental body, that uses its own definition.

Maybe they're going by one dictionary definition of "animal,", which is "a mammal, as opposed to a fish, bird, etc.".
