So what I'm told is I have a clog in my main toilet drain on my second floor and it's causing water damage to my first floor ceiling. I just bought this place this year, should i fight for the builders to repair the ceiling or am i going to have to since the clog may be my fault?

De L,when that happens and the floor joists below the toilet re-veil the moisture, its in the toilet itself.
What you probably have is a wax seal installed incorrectly, ants ate enough of the wax to cause a leak or the wax seal itself is just ready to be replaced.
If you have a seal that is not obviously sealing and when you have a backup in the toilet trap, you harbor liquid around the seal and it slips by and deposits on the surround at the ring.
If they have also sealed the toilets bottom to the floor with a good caulk/silicone it will become a swimming pool under the toilet and then proceed to penetrate the flooring, thus come out on the ceiling below.
If you have another toilet below or in-line on the same pipeline, there could even be a clog lower than the upper toilet itself.
remove the toilet and put on a double wax seal and let the floor air out/dry. then snake the line or go outside or in the basement, whatever your situation is and open the clean-out in the 3-4" sewer-line and remove the log-jamb.

Normally I have solutions for such plumbing questions but in your case... it sounds as if the toilet is plugged up and if there was or is a warranty on the house still.. I would have the builders repair it soonest... I Just do not have enough information to give you good or better advice.. I do not know if the house is OLD or new.. You did not give me enough information.
