I heard that this was a defect from 88-91 Evo's...would warranty cover, even with 16 years on the bike?

Dream on dude, The good news is ,if you can wrench it's not that hard of a repair. Pull the primary, then the stator, pry out the seal . There is a special tool to re-install the seal ,but as long as you put it in flush ,you don't really need the tool,(I've never used it).Make sure to use red loc-tite and torque the compensator and clutch nuts.

Rather than a factory defect, I'd think it's more like a 16 year old case seal. (Not that hard to replace, but labor intensive).

I don't think so. The warranty has expired by 15yrs
