Well I am not pretty much sure what your question means. Assuming that fooling means that the stories of two are a bit different, than I will say yes he has the right.
There is no law that the same named movies have the same stories, I mean there are many movies with duplicate titles right.
Another point to note is that a plain remake of movie would have resulted in complete comparison of both the movies, which would have been problematic for director/producer.
Lets see the new DON as a new movie all together!!!

Well, first of all you are allowed to fool people into coming to see your film as much as you like, but secondly, I don't know what you think he's fooled anyone into doing. I've seen the original Don and the new Don and while they are both good, the original is outdated and downright silly in many places. Indians are attached to it because it's old and nostalgic. They really need to get over that.

where ahas he fooled people???he has just shown an "adaptation" from old DON from his creative angle.
he would have fooled ppl when he would have claimed that its a 17 reel movie and in reality it would have been 14 reel movie. Nothing that ways happened.

Read the words given in the movie before it starts. DON is a COMPLETE fiction movie and there is no "Fooling the Audiences" as you said.

where has he fooled.... its an adaptation... when omkara can be an adaptation of Othello so why cant the new DON...be an adaption of the old one...
And whats the harm done... you are left surprised and gaping...

i think it is total ..Paisa vasool...otherwise who would go just for the sake of SHahrukh KHan and his idiocies..
