Not sure what you are asking. If you are a witness to the signature, you are just saying that "x" signed tht paper - your witness does not determine if he had a legal right to do so.

A public notary has to witness the signing of the document. Most banks have somebody who can act as a notary for a small fee.
The notary is sanctioned by the state and is an official witness. If the notary said you signed the document, they mean it and that is good enough for the courts.
