father will not let me have any visitation with my son and he is trying to keep my from having anything to do with my son. he would not sign declaration of paternity in hospital , so the took him of the bith certificate. i am only on there.

the father has my son because he asked me if he could that him to texas to see his mother be cause she was in a coma and dying . i sign a paper giving he promission to take him to see is mother because she was in a coma and dying. well come to find out his girlfriend had my son the two days he was there and i found out about her a day before he left to see his mother and we were still together , he left me and my other son on the streets. he will not let me have my son .he will fight with my and try to hurt me if i take my son. i have seen my son twice and only for a few mintes. and know he won't let me see him at all i dont know where they stay and they changed the phone number or they don't answer. they stay in am motor home very small and they let her little girls bit and hit him. the first time i got to visit with him he had a black eye and bit marks. i love my baby alot and i cry for him all the time this is longest i have been away from his. i am stable and i am lost without him

I am not sure I am understanding what you have said in your question. These are the points as I am =reading= them here, one at a time...but I have a hunch I'm not understanding what you meant to say. Please correct or confirm:

You are asking if YOU have custody rights if the father is not on the birth certificate.

You have said that the father will not allow YOU to have any visitation with YOUR son.

You have said that HE is not allowing YOU to have anything to do with YOUR son.

You have said that HE would not sign a Declaration of Paternity in the hospital.

You have said that HE was removed from the Birth Certificate.

You have said that YOU are the only one listed on the Birth Certificate.

Now, to me, if you're the only one listed on the Birth Certificate and he has not signed a Declaration, you should have custodym plain and simple. Of course, this also means that he probably also won't be required to pay any child support until you either get him to sign, get him on the Birth Certificate...and/or insist on DNA testing, but that's another story, at this point...

You need to get in touch with Legal Aid and get them working with you on the rights of you and your son.

Yes. But the father can ask for DNA testing and prove he is the father and have rights. The other girls are right...you need a public service advisor. If you cannot afford an attorney contact social services and tell them the problem.

You should consult with a family law attorney in your town. If you can't afford an attorney, contact Legal Aid (if you can't find them in the phone book, call your state's Bar Association for their number.

You need to get an attorney--quickly. There are legal aid lawyers in every major city. Contact the office nearest you.

yes, you need to contact legal aid society,,,, also , unless he established paternity, if you are not married to him, and he is not on the birth certificate, he at this time has no custody rights

the scenario leaves a lot to be desired. you are the only name on the birth certificate-where is the kid? the kid is with the natural father or where? was the child taken from you due to neglect?
