I just wanted to know if a person dies leaving a Social Security check signed but not cashed that was issued before they're death. Can that check be cashed by their estate?

more sorry, I suspect, then the social security people.

I know someone whose husband died while on social security. It was at the middle of the month, and the social security people demanded the whole monht's worth of money back. It didn;t seem fair, since part of the check was legitimately spent on the person. They said not, that they needed the whole amount, even though some was spent on food and prescriptions for the guy who died.

Go figure. This doesn't seem fair to me.

In the case of some one who is deceased already, I wouldn't. The check is not intended to be an asset to the estate, but to provide for a living human being.

I had to return a Social Security check that was for my uncle. They keep tabs on those things.

Probably not a good idea when in doubt call the SS office and ask them most likely you will have to send it back

no, you cannot cash any checks after a person has died. you are not that person and therefore are committing fraud. sorry!!
