Tort OR reulatory law?

Which is a better approach to dealing with problems caused by tobacco? Is either approach likely to be successful in the near future? Can you explain why?

Tort is a stricter law but might offend the offenders. Maybe, the regulatory law could be a better choice but must be implemented properly.
