the 16th ammendment tells us that we can only be taxed on profits and gains, not wages. Income is not taxable by the federal government. It also states that this can not be ammended. Therefore, why are people going to jail for not filing a 1040, when there is illegal for the government ( oops, disguised as the federal reserve) allowed to tax us? We need to know our rights. If you are ever in a court facing charges for not paying federal income tax- tell the jury to ask the judge for a copy of the law that says you have to pay. You can not be charged.

federal income tax goes against the 16th ammendment. I'm not talking about local and state tax- federal! why does everyone tried that presents this point to the jury get off scott free? because they haven't done everything wrong! not one cent of what you pay goes to fund anything,. all that comes fro mstate local, and other small taxable services. we need to bring back Thomas Jefferson! let me quote george W. "the constitution is nothing but a goddam piece of paper"

the amendment was never properly ratified and the federal personal income tax remains unconstitutional because being a direct tax, the personal income tax violates the apportionment clause of Article 1, Section 2 of the U.S. Constitution. let me state that the IRS code was written after the constitution!

In 1913, the Sixteenth Amendment to the U.S. Constitution was ratified. It empowered Congress to tax "incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration." The Internal Revenue Code is today embodied as Title 26 of the United States Code (26 U.S.C.) and is a lineal descendant of the income tax act passed in 1913, following ratification of the Sixteenth Amendment.
While some states do not have an income tax (Nevada), all residents and all citizens of the United States are subject to the federal income tax. Not everyone, however, must file a return. The requirements for filing are found in 26 U.S.C. 6011. As the largest contributor, its purpose is to generate revenue for the federal budget. In 1985 for example, the government collected over $450 billion in income tax from a total of $742 billion in total internal revenue receipts. The funds collected are essential for the shaping and preservation of a free market economy.
Some terms are essential in understanding income tax law. "Gross income" can be generaly defined as "all income from whatever source derived;" a more complete definition is found in 26 U.S.C. 61. Other important definitions like "taxable income" and "adjusted gross income" can also be found in Chapter I of Title 26. These terms are not fixed nor should anyone be confident in understanding their true meaning after a cursory reading because their imputed definitions change with time. The Supreme Court, through case law, demonstrates the changing meaning of taxable income.
Individuals are not the only ones required to file income tax returns. Corporations do as well. While they are subject to may of the same rles as are individual taxpayers, they are also covered by an intricate body of rules addressed to the peculiar problems of corporations.

You've totally misquoted the text for one thing. The 16th amendment actually says:
"The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration."
So, the federal government has all the authority it needs to tax your income, from this amendment. You don't like it? Propose a repeal.

You are correct that the IRS Code was written after the Constitution, but it has also been upheld by the Supreme Court as Constitutional, which means it is a valid law and illegal if we do not abide by it. I'm glad you feel you know the Constitution, but as you may also know, it is open to much interpretation, and that interpretation is typically by the courts, not each citizen. You can and will be charged if they find out, so I suggest just paying your taxes. Additionally, if you don't pay your taxes you are selfish and unAmerican. Taxes aren't a bad thing per se and our society would not survive without them.

Internal Revenue regulations governing practices of the IRS agents are created by the IRS itself. But the Internal Revenue Code is different; it is a law of the federal government — passed by Congress, like any other federal law.
Anyone who says that there is no law requiring the payment of income tax is ignoring the fact that the Internal Revenue Code is a law passed by Congress.
You might decide to refuse to pay tax as a protest; that's your decision. But if you refuse to file or pay because you believe there is no law requiring you to do so, you're sadly mistaken.

You are mistaken. Income tax was ratified by the constution and subsequent amendments, and codifed into law by Congress.
The Supreme Court has considered and supported income tax as legal and constitutional.

It is my understanding that income is not taxable but you are not paying tax on money that you make.....you are paying tax for the right to earn that income, not the income itself.
Oh, by the way, the 16th Amendment is a fraud--it was never ratified by the states.
