My husband and I moved in together in 1997.
We were married in 2003, and separated in 2005.
In 1997 we moved into a house together with his name only on the deed.
We had a joint bank account in which we pooled our money. We mostly used his money to pay the bills and mine to pay for groceries and fun. We still have the joint account although he no longer contributes to it.
I don't want to take him for half the house, but I think I do deserve to leave the marriage with something. Is this possible?

1) Take everything out of the account and open another account, only in your name, in a different bank.

2) Get an attorney who specializes in divorce law and common law marriages. You are in California and you have MANY RIGHTS there.

3) Don't breathe a word about anything to anyone and don't let anyone know about your other account.

The house was in his name before the marriage so I don't know
that it will become community property in CA..
CA is a community property state so you will have to check with
a lawyer...
I have never heard of any woman coming out of a CA marriage
with nothing to show for it...
CA laws are very generous to the woman..

my hubby and i just bought a home, i wonder if your name is on the title, mine is but not on the loan, you will need a lawyer but here in az there is no such thing as comm. prop. close the joint account and get your own account, also you can ask for half of everything.
