Assuming your friend didn't get knocked out by drinking or drugs, he did nothing wrong. If he DID get knocked out by drinking or drugs, he put himself in the same position many people think only women put themselves in at parties.
I think your friend's 12-yo brother is lucky his dad didn't find him doing it.

I don't believe that he did anything illegal, but his brother, well, that's called incest. Tell him to talk to his brother (as weird as it may seem) about it, clarify what happened, and maybe talk to the parents and get some professional help.

if your best friend was drunk, he would be guilty. I think that is disgusting. it is kinda like incest, a sexual encounter or intercourse between one and his or her family relative.
