Well, if you wanted to make a GSM phone, all the standards are online and free: www.3gpp.org. There are 100s of docs, many are 100s of pages long. Many are related to the handset. Others to the network itself.

It would be a huge undertaking to do it from scratch. Once you made it, you would need to get your transmitter approved before you could use it legally.

You would still need to buy a SIM card from an operator in order to use their network. The SIM card has a secret encryption key that can't be read or copied.
