It is almost never capitalized. Others have said "judicial branch" should be capitalized, but that is not normally true. "Judicial" is normally capitalized only when it forms a proper noun in a phrase like "Board of Judicial Review".

Not necessarily -- depends on the context (as is true with most of these kinds of questions... the correct answer depends entirely on the context... so it would be very helpful if people would include context in the details of their questions)
