Yes. By making a copy of the DVD without the owner's permission you have engaged in copyright infringement. By selling said copies you have also committed copyright infringement. You may be subjected to statutory damages under the Copyright Act in a civil suit for up to $150,000 PER INFRINGEMENT (that is per copy made, per copy sold). See 17 U.S.C. 502(c). In addition, wilfully copying a copyrighted work for commercial gain may subject you to CRIMINAL penalties. See 17 U.S.C. 503.
Unless you're a huge pirate, criminal penalities are unlikely. But film and music producers DO crack down on pirates all the time. I've seen many cases.

Copyright laws are governed by teh prevailing law which holds jurisdiction. Copyright laws in Australia prevent you from owning pirated DVD's.. so the manufacturer, the seller, the purchaser, and the person in possession all have a case to answer.
