My boyfriend was driving my car and hit a illegal imigrant, I was in the process of changing insurance company's because i got a letter saying they wouldnt cover my boyfriend when i tried to add him , The imigrant was coloring outside of the lanes and slamed over in the other lane and breaked it , my boyfriend hit him , the cop arested the imigrant and told my boyfriend the imigrant was not insured, My boyfriend hot a ticket for carless driving .The acident messed our car up pretty good , it did nothing to the imigrants big econ van , we paid 3000 dollars out of pocket expenses to fix our car , i got a letter from the Imigrants insurance company today saying we owe the imigrant 21,00 for loss'es, if we do not make arrangments to pay we will be sued. What happend if we do get a judgement to pay and dont? will they suspend my boyfriends licsense ? it did no damage to his van , i dont feel we should have to pay , i dont understand why we were told he didnt have insurance if he did?

I'm fixing to go pick up the police report and get to the bottom of this , the guy didnt speak a lick of english , and he thought he was being deported when the cop arested him , that's why i think he was ilegal , the cop didnt tell us why he arested him

Stocko's generally right regarding what happens if you don't pay. Having an unpaid civil judgment will haunt you everywhere you go, from credit to job applications. You may be forced into involuntary bankruptcy. DO NOT let a default happen. Get an attorney, or at least proceed "pro se" (without an attorney) and answer any lawsuit. Because the insurance company knows you're not represented and didn't have insurance, they're going to go at you hard. Merely getting a lawyer (if you can afford $1-2,000) should help this settle quickly.
How do you know he's an immigrant? And how do you know he's illegal? If he didn't speak a lick of English, how did you know what he was saying re: insurance? You know that committing felonies is often grounds for deportation, which may be why the person was concerned. And he likely had insurance all the time--because insurance companies wouldn't indemnify and defend him if he just got coverage.

Immigrants injured in the US have a right to use the US courts to be compensated. How would they sue you otherwise?

If you are sued, you will need to get an attorney. You are in trouble, you didn't have insurance. So yo will be personally liable for any judgment against you.

If you are sued, get an attorney. Your boyfriend will probably have to get a seperate attorney because you will have conflicting interests. You will probably have to sue your boyfriend as well to indemnify you for any liability.

The fact that the driver was an illegal immigrant may help you settle.

If they sue you and you do not respond they will obtain a default judgement against you. Once they have that, they can sieze some types of property, but probably nothing unless you have extra assets like a vacation home, non retirement stock accounts etc...

They will ruin your credit unless you dispute. You can't have your license taken for non payment of a civil debt.

if he is illegal the case will be dropped. he prolly got insurance after wards to try and cover his ***.or the dumb *** cops messed somehting up. if he is illegal screw him he shouldnt have hopped the gate over here. just go to court and fight it. i mean unless he can prove you hit him(in the police report) then he dont have a case.
