I got a $4200 insulated patio cover on my screen room installed in early October. One week later, it rained and leaked. I called the company and supposedly they came out to fix it although no one ever called or knocked on the door. Two weels later, it rained again and it was leaking bad so I called. This time they called before they came out and were there for ten minutes to fix it a week later. On Nov 16, we had another rain and I don't know what they did but it is ten times worse than before. It is leaking so bad I might as well not even have a cover. I called and they are blowing me off. They said they called me last week to come out on my cell and home phone but I have no messages and nothing on the caller ID. It hasn't rained again and I was patiently waiting before it did but now it may be another week before they can come out. I am worried it might never be corrected. I have pictures of the first leak, video of the second, and pictures of the third.

I threatened to call the BBB and was told they have all the documentation they need of fixing it and calling. I don't want my money back and just want it fixed. I removed all old cover to put this one on so I need it fixed. Should I contact the BBB and send a certified letter to the company? Please tell me how to handle this should it never be resolved and I do have to sue to get my money back or how to get resolved in a timely manner.

Yes, I would contact the BBB and I would also contact the local States Atty. office and tell them about the situation. I had to do this for Dish Satellite, although they were in a different state. But it worked and I got my money back immediately. I had all documentation and sent it to them. The company wouldn't answer my calls or return them either. So I just got fed up. By all means go over their head. Most companies are reputable but there is a small percentage that makes it bad the for rest. The ones like the one you are dealing with doesn't think anyone would go over their head. Just remember, everyone answers to someone....EVERYONE!!! Good Luck!!

Call them again and again if necessary, "the squeaky wheel always gets the grease", if you know what I mean. Tell them you will report the matter to the Better Business Bureau and the local newspapers so that they get the message you are quite serious. If this does not solve the problem, then yes, proceed with legal action but be prepared for the costs involved. Contact a lawyer to commence a "Show Cause " action and commence issuance of a writ. Thereafter, proceed accordingly.

Simple. Instead of calling on phone, go to the company, meet a person, tell them what has happened and what you want. If that person is obtuse, raise your voice a little higher and demand to see his/her superior officer. Do this until you are heard well and you get a promise to get it done

This is a problem - call them one more time and tell them that their is a violation of the warranty and that if they do not come and fix it you are going to institute legal action

Why dont you try to send the proofs to the company.

If they dont respond properly, you may sue them.
