I believe that if your Husband was to file for a divorce,and you contested it.(in other words you do not agree with your Hus. that this marriage should be dissolved in divorce)your Hus. could not divorce you unless or en till you have been legally separated for a period up to six months to one year.But if he was to be able to prove that you abandoned the marriage,the judge would probe consider letting your Hus. have a uncontested divorce(in other words you could not stop your husband from being granted a divorce within 30 day's to 6 mo.'s.That is the only thing I know of that he might could use against you.If you leave protect yourself by getting legally separated for other reason's also.financial,Federal and IRS reason's,insurance,etc.etc.Being legally separated does not mean you are filing for a divorce you could have a year or more be four deciding on a divorce or not.GOOD LUCK. on another note all together it isn't like he is a child,if there is children involved though,please think of the children,and let him hurt you so much that you would abandon your children.

There is obviously more to the story and without a good idea of what is involved it is difficult to give any advice. You should call a lawyer or talk to your clergyman or a counselor - if children are involved call child protective services to find out about your rights and what options you may have. It depends on where you live. It's best not to leave because it can be seen as abandonment and it can't be proved that he told you to leave unless you get it in writing. Go to an attorney. A lot of them give a free consultation. Or call your local bar association.

My ex walked out me and the kids...I tried to file abandonment charges against him...but, the judge pretty much told me ish happens. You can try it and see what happens, but now a days spouses walking out is the norm.

I've always wondered what the answer to that was myself. If he's already made you leave, you need to contact a lawyer and fight this. Your husband sounds like he may be a control freak. If you are gone, he only has the kids to control and you can't let him win.
