had a woman come to my house spit and swing at me forcing me to fight-when the police came I was the only one who went to jail.yea i swung back and split her face open,but stopped as soon as i seen she was hurt and bleeding.the woman then started spitting blood on me and smearing it on me saying "WELCOME TO MY WORLD & ARE YOU FEELING SICK YET" but i was the one who went to jail is that right?

no its not right. it sounds like self defense to me. im sure you will win in court...do you have any witnesses? you must, since someone had to call the cops

Appears to be mutual combat.

If you were charged with battery then it sounds like one of two things:

1. You did more than defend yourself.
2. You are not telling the whole truth and you started it.
3. They have a witness that places you as the aggressor.
4. You had the opportunity to avoid the fight by say not going out side and fighting. This would then be considered mutual combat and in that case who ever is hurt worse becomes the victim.

In the case as you mention, police tend to arrest the individual they see as the bigger threat to the other. Obviously, you must have done more damage, so you were seen as the bigger threat. The only other question is whether or not there were any charges pressed, because your case could be easily defended if there were witnesses and/or evidence. If there is none on either account, it should be dismissed in a fair court hearing as an undeterminable culprit. However, in many similar cases, the individual who did the damage would be the one to pay for any medical expenses as a result.

Because they are spineless creatures who are miserable and unhappy. They have no life and hence fore sit behind a computer and wait to "assault" innocent" victims who are just trying to help others. They have no life, no friends and act out in very inappropriate manners. What a lot of people fail to realize is that if we just simply ignored these trolls and didn't give them the negative attention they crave they would simply shrivel up and go away, they "live" off the bad attention they get. You know what the problem is? The cops know who you are! Right? Maybe been booked by one of them before? And if this is the case, nothing matters! I'm certain that if looked at,anyone could see it like i do, that the personallity traits are always the same in cops. the have a need to be in power, or the need for "the rush" of smacking down someone.This ,i'm sure,is due to what sime call "Small Man Syndrome". I would almost bet RIGHT?

Unfortunately the laws are pretty screwed up in many states. Being in Alabama I've learned how pathetic law enforcement can be.

I look at it like this. This woman came to your house knowing there were problems. She was showing aggression first by coming to your house. You would think that someone wouldn't have the right to assault you on your own property but I know in Alabama they get away with it. I was pulled off my steps clothes torn and back welted and bruised because my neighbor was a drunk and starting with me. I was told that I would go to jail if I pressed charges. Good ole hicks for ya! A few months later her husband was drunk and came after me threatening to kill me. The judge found him innocent because he felt provoked because I set up a live trap, after being advised by the local Animal Control, to catch the animals scratching up my car..... laws are messed up!

Why did she come into your house in the first place? If it was for something that you started then you got what you deserved. No matter the reason you still got to beat her a$s. You should be happy about that and who cares if you spend some time in prison. You can make some dangerous friends and get that bi**h killed if you like. Prison will make you some mad friends. I know that I wouldn't be here today if I didn't have my criminal family behind me. I would do anything for them that doesn't go against my morals and they would do the same. Prison is good fun.

i was attacked from behind ( swung at and spit on) as soon as i turned around-- i pulled my knife and proceeded to defend myself-- i was tthrown in jail for menacing- unlawful use of a weapon and attempted assault 2degree. the person who attacked me was a former renter who i evicted for pointing a shotgun at me and my wife. my court date is dec 5th (jury trial) the d.a. said i had no right to use deadly force (a knife) this lowlife held a shotgun at myself and wife-- he was released the next day-- this scumbag renter had already proved to me of deadly intentions 3 weeks earlier pointing a shotgun at me and spouse-- when you are attacked from behind by someone half your age-- alot bigger and dont have a chance to see if he was armed-- i did what i thought was appropiate under the circumstances-- i guess the jury will decide my fate-- either i will be aquitted or serve 30 months in prison-- we will see soon who the victim will really be

No, that's not right/fair. And, it will prove as such in court (hopefully).
There had to be witness(es) to call the cops, and clearly it seemed as either A) they said it was you attacking her, or B) the police clearly saw that she was more harmed than you, and took you assuming that you were the aggressor.
I say just continue to push the self defense argument, saying that even after you had warded her off slightly by bloodying her face, she continued to push and assault you.
There were most likely witnesses who will likely affirm your case.

From your story I would say that you were fighting in self defense

but, there are two sides to every story. I find it hard to believe that the police would arrest you, when a woman, who just happend to come over to your home and started attacking you, in your own home.

doesn't sound right to me - there must be more

She obviously wasn't the Avon lady so you must have done something to this woman to cause her to visit your house sounding really ticked off. I'm sure the cops heard both sides and she won. You aren't fooling around with her husband are you?
