Hypothetical situation. A black magician casts a spell on his victim with the intention of killing hime. The victims family find out about this and are obviously angry and want justice. Would there be anything she could do about it via the court legal system? I mean, would the law actually recognise black magic and consider it as a weapon or whatever?

While the law does not recognized black magic as a direct cause-and-effect weapon, if the DA can show that the spell somehow clearly contributed to the death - directly motivating a killer, or if the victim knew of the spell, believed in it, and it contributed to his/her death - then the case could be made as a contributing factor, possibly a copnspiracy charge.

No more burning of witches, no such thing as magic in the eyes of the law.
You can even openly go and tell somebody you put a spell on them, all that could happen to you is being laughed at, even if it has consequences for your victim, because s/he believes in magic.
There is no way it could ever be proved that your words actually caused the harm.

I think the person who casts the spell would be protected under the consitution. (Freedom of Religion). If someone casted a death spell on somone how would they prove it. I never heard of a law that prohibits anyone from casting spells on someone.

I have personal experience with this and unfortunately there was nothing that could be done legally. In my situation, my niece got caught up with a 40 yo married man whom practiced wicca. This man had made his own tapes to give teens, which would come to his house and do drugs mainly, but also believed in his cause. He has the pentagram, the master chair, the candles and cast spells. He even told my niece that he given her powers to sleep talk and go into peoples dreams. He would give her different rocks that was for differnt purposes, like pertection spells etc. This man considered himself as "First Degree Correllian Wicca Priest" and he had many "kids" believing him and following him. I gained custody to get my niece away from this man, but he was so into my niece's head that she couldn't sleep and she would keep saying that he was following her and she couldn't make him stop. I put her into counseling and she refused. She also got into cutting to relive her pain of what she thought was actually going on inside of her...this man had brain washed her and she believed. Unfortunately they also were in love and he showed her how to write spells to cast death upon a person, mainly having her believe that she could write a spell and make his wife dye so that they could be together. My niece needed mental help and refused by running away back to him and they have been in hiding waiting for her 18 birthday. It has been a long fight, since she was 16 yo, but, in the end we could do nothing by law...not even for him taking her from our school where we had her inrolled. He had even been served papers from court to not be around her, contact her, or to leave the area he lived to come to her. So, he had a friend pick her up from school and the law said we couldn't do anything because he wasn't the one whom actually took her from school. I feel for anyone whom has to be in contact with this kind of situation because there is no help for you and you will be left hurting and worrying just like us. Unfortunately most don't believe in the myths of black magic nor the fact that you could sleep walk into peoples dreams nor cast spells. Good luck to anyone, you will need it, we are still suffering from our lost.

No. What does not exist cannot be legislated. However, the Democrats are now in control so watch out.
