We have had the belongings since Nov. 13, 2005 and there has been many emails, phone calls, and contacting family. We even contacted her mom and her mom came and picked up some things that wasn't runt by mice. Her mom has even tried to contact her. She lives in Illinois and we had to drive there to get our car back, but she refuses to come and pick up her stuff, nor has she called back any return calls or messages since 2005. I don't know if there is a difference between our KY law and her Illinois law or if the two states make a differnce. Since her belongings are here, do we go by KY law?

If you call your local PD they should have no problem telling you what the laws for the state of KY are regarding this

Chances are abandoned property becomes yours to do with as you like. In MD it is after 30 days, states may vary but after a year it's got to be yours. I would suggest contacting your local police dept to make sure, but you can probably get rid of it with no legal problems. And the law in Illinois is irrelevant, the items are in Kentucky and Kentucky law is what will apply.

since the items would be considered abandoned unless there was any agreement for you to keep or store her items, you generally only have to show that you have made more than a reasonable attempt to contact her and warn her of the future status of her things if she doesnt make arrangements to get them. There are laws in states that use different formats so contact your local sheriff as he most often serves most of the civil process or contact your circuit court clerk who handles civil litigation.

Do what ever you like with her things she gave up her claim to them, keep copies of your attempts to contact her. Even if it had been a car she had only a matter of months to pick it up.
