If yes, what is the percentage to be paid?Recently, FM, P Chidambaram has clarified that Apartments doesn't fall under service tax category. Still, most of the builders charge service tax to the builders. Pl clarify?

Service Tax is leviable only in those cases where a contract of construction has been entered. For example; if the builder has built the Apartment on his own- there is no liability of service tax.
If the builder gives a contract to the contractor for construction of apartments it can be liable to service tax if it is a case of contract of construction of residential complex having specified facilities.
Since you appear to have entered into an agreement of sale of apartment with the builder; there is no liability in this case.

yes, if no of appts are more than 12 , you vve to pay 12.2% service tax.
