I've been goin to court trying to fight my charge with a public defender but it hasn't been looking to well. I can't afford a private lawyer. Since i was arrested i got a restraining order and sole custody of my children...He says he will not turn himself in, and my lawyer tells me that even if he did i still would be charged. I have never ever been in trouble with the law and obtained my apartment for 3 years before i allowed my ex to move in...within 7 months the police were busting down my door. i am not listed on the search warrant but the description of my ex was. they are trying to give me a felony and 120 days of community service....I am NOT GUILTY so ive been fighting this since June 2006. I currently am having trouble finding employment because my background checks show that i'm currently goin to court for the charge. I dont know what to do or anything that can help me with my case. My public defender doesn't seem to be to interested...

Some people are coming at me fool, because they dont know the whole story. I let the father of my kids come and stay with me thinking it would benefit my kids 7 months of the worst relationship ever, I had police men busting down my door asking where my boyfriend is. 6 months pregnant and with a 2 year old i was charged with possession of sale of marijuana, while Mr. coward ran when he saw them coming. The searched my apartment and found 2 ounces of marijuana in a very high cabinet that i would definitely not store anything in or bother to look in because i am only 5'4. Anyways I DID NOT know he was selling weed out of my apartment for the simple fact that he never had any money, he smoke it way to much for me to think he could sell it, and i never seen it with my own eyes, but yet there charging me because it "was" my apartment. I'm not asking anyone to be sorry for me because i've come to deal with this deck of cards, i'm just asking for some advice, or just some answers.Thanks

fire public defender which creates conflict of interest. have court appoint a Private attorney. get full discovery and find out where this boyfriend is if he doesn't own up give info to your lawyer - da. i know u don't want 2 be a snitch but if you don't you will be convicted of at least possession, if not distribution

First of all, I'm sorry about your pain. But, much like owning a car the lessee is subjected to the same requirements that a title holder is. That is, the owner of a property is responsible for all activity, whether legal or not, that happens on that property. It wouldn't hurt to fight it. Try getting a private attorney, they're more likely to get a sentence reduced or dismissed. Consultations can sometimes be free but usually cost no more than $100. Good luck...

My boyfriend and I are potheads. I know I am guilty and a horrible influence on my children, but being the good liberal that i am i am trying to blame everything on someone else, and refusing to take any personal responsibility for my actions. I am assuming that the judge is an idiot, and that he will believe i had no idea that people were coming to my door 35 times a day and paying cash for what i thought was oregano....its not like i LIVED there or anything and that this went on for months. My public defender knows i am a piece of dope smoking crap and knew it was being sold/i was selling out of my home while my kids lived there.....i dont blame him for knowing i am guilty, but again I am looking for someone else to blame for my actions. Now the truth about me is out and decent people dont want a criminal working for them. Will anyone out there cry and feel sorry for me?

First off some of these answers you are getting are ignorant and in no way should you be treated like this.

I would suggest finding a laywer through NORML

If you have a legitimate case (which is sounds to me you do, especially if your name wasnt on the warrant) a lawyer may feel it is his or her civil duty to protect you and do it for a small fee.

PS-your public defender sounds like a real asshole and its people like them that put holes in this justice system.

I really hope you find your way out of this mess, and fate be on your side.

If your State law allows, call him up and get his to admit it was his fault, just make sure the tape recorder is running at the time.

sorry but i dont buy you not knowing that he was dealing out of your house.did you not know that he was using?that stuff stinks.your only hope is for him to testify but being the upstanding person that he sounds like i bet that he wont.not to sound mean but no one ever knows this is happening in their house.

Tell the prosecutor where he is in exchange for dropping the charges against you.
