You should probably contact the Child Support Agency for further information if your husband has agreed maintenance payments with them. FSee below for the link.

You need to seek professional advice loubag, as I have a sneaking suspicion that your money may well be at risk.

I retired from advising on social security law 9 years ago, and I recall circumstances similar to yours where the wifes capital and income is taken into consideration by the Child Support Agency. But there's been so many changes to the law since then, I can give no definitive answer.

For free (no cost) guidance, go to either a debt counsellor, welfare rights agency (such as Citizens Advice Bureau), or a duty worker with your local Councils social services department.

Or see an appropriate Family Law solicitor.

Hi Loubag, This is an interesting one. His ex would have to go back to court to get the case reviewed and it may go against her if it can be shown that your husbands' outgoings have increased as a result of obtaining a mortgage. Certainly in the first few years of the mortgage. She might demand that a share of the interests in the property be secured for the daughter in the event of his death. This is an equitable interest on her behalf. This normally includes pensions and any life assurance policies as well. It can be a complicated area of law. The main thing is that it is up to his ex to chase these things up. If she does not know about something you are not obliged to tell her. DONT volunteer information. I assume that your husband has lost is job or been made redundant ? That being the case he can apply to the Court to have his contributions to his child's welfare reduced for the time being. If, however, he has been promoted and his salary raised accordingly, then his ex girlfriend (if she finds out) can apply for an increase in payments. You are not responsible for any payments to his ex girlfriend and your own money should be safe. I am assuming that you have your own bank account and it is not a joint account ? If it is a joint account, then I would open a separate bank account and ensure that any personal monies from now on were paid into that account. You cannot transfer funds now from a joint account to a new separate account as the Court will assume you are trying to evade a Court ruling and are pulling a fast one. They tend to frown on this. It depends on the situation. Is it your money? Did you have it before you married. Basically what they will do is if she requests a review of his wages they will go by his and hers you will have nothing to do with it.
