Since this is a civil case there is very little chance of being able to force her to show up for court. However, go ahead and file the papers and have them served on her. If she does not sign them or respond to them then you may be able to get a judgment by default. And if she has them signed and notarized you may just be able to get your divorce without her showing up. Check with a local attorney or with your local courthouse to see what the laws are regarding this issue.

First of all check with the courts in your state to find out how to go about filing for divorce with spouse in another state, each state has it's on regulations regarding such.

You can actually aquire your own devorce papers for a minimal fee from the News Papers, in the ad sections.
It is legit, then you have to file with your local court, but must have her signature on the papers.
It costs around $200 when it's all over..
Or get a devorce attorney, which will cost you about $1000.

Apply for divorce in the state you were married in or last shared a home in. The law does not care if she is in court or not if you file. You can do it without her if she does not contest. It simply needs to be filed in the state of jurisdiction which is the above.

Just do it! If you both agree and have no assets there should be no problem go to the court house file.Your lucky thats a easy one .She shouldnt have to come to court,if you both agree just sign papers you shouldnt even have to go to court.Maybe cost you 100 bucks if that!!

Looks like you can both use some counseling. Is there a legit reason for divorcing her, or did a new hottie just sweep you off your feet? Just curious.
