Well, I just got my bill and it was $70 extra which is very odd because we don't talk on our phones much. I looked at the bill and noticed that my husbands phone had over 1500 minutes used in the past month. I have called and left a message on his phone to talk with the people who have it and I have called a few numbers that they have called a found a lady who knows who has the phone. She will not tell me the name but she said she would talk to them for me. I am reporting the phone stolen in the morning and I will give the person 1 day to call me back and try to work something out. As long as the people return the phone and pay the extra money they charged or see if it can be dropped by cingular then thats fine. Is there something else I should do in the mean time.

The same thing happened to me. AZmom is right on the money. Call the police, or go to your local station, explain your situation, and have them call.
$70.00 is a cheap mistake, all things considered. He could have called all over the world, and you'd be stuck. You got someone who was stupid enough to admit that they knew who had the phone. Exploit that stupid woman and milk it for all you can.
You can always call her back and let her know that you'll be happy to consider her an accomplice for the theft of personal property and fraud - and then follow up on pressing charges - if she'd like to go that way.
I'd threaten to nail her to the wall. And then do it. The cops will know that also, and be more polite about it. :)
A nice civil court judgement after the theif's arrest would pay for both a new phone, and the difference on phone bills, and civil court is almost next to nothing - like $15 bucks to file.

a police report needs done before a cell company may forgive this debt. but mostly it is only good for the date the police report was filed. depending on your history with the company they may forgive it. most the time if you do not care enough to try to retrieve the damages caused by theft why should the phone company eat your mistake
