I don't know what state you are in, but in Pennsylvania you may as well forget it unless the mother is a convicted axe murderer or a convicted drug dealer.

I had the head attorney for a powerful family law lobby in PA and I ultimately lost.

For even half a chance you need to have a friend report her when you know she is doing drugs and have her arrested. Be careful though, you are still the husband and can't be a witness against your wife in many instances.

I cannot belive how little the family unit means to some of you.
Do not show your son anything having to do with his mother's drug use. Shame on all of you who suggested it, you obviously don't have children!

Don't talk negatively about her to your son EVER! This will backfire. Explore all your options first, do you really want a divorce?? Only you know the answer to that question. If you do, remember this: your wife may get clean soon, so make sure you keep your tongue to yourself because your son will never be able to think critically about these types of situations if you don't let him discover the facts, analyze them and decide for himself. He needs the footing to make his own decisions based on his own perceptions.

Also, in family court, your sons best interests come first to the courts, and I would tend to believe that you and your wife should follow suit. No bashing each other because it serves no purpose. Also, I don't know how old your son is, but he may be immature for this type of heavy duty problem. Protect him and his relationship with his mother. He needs her even if all of you don't think so. My parents were alcoholics when I was a kid, and it was commonplace, but we didn't throw our parents away like CPS would have us do. The family unit is so detrimental, even in dysfunction. It builds character folks.

Prove she is doing them!!! Pitchers Police Reports Etc.
But if drugs are the only problem are you sure you want to divorce? maybe you could get her to go to rehab or some thing like that. Be a man and help your son's mother.

Think about what it will do to your son to be without his mom.

Doubtless this has already occured to you but try to build up the proof that she is on drugs? Also, I would guess that the less hard the drugs (pot vs. crack) and the less the frequency (a couple times a month vs. a couple times a day), the less of a chance you have.

Think of your Child first and if shes doing any bad drugs don't worry it will all come out! But anytime she has your child and something should happen be sure to write everything down with dates and times and places.

i' have been there and done that it took me 7years to get my little girl you have to fill for the Divorce first then you your self need to be clean of drugs or the state will get the kids .
DCS must have complaints from sources other than your self and you must have proof of her doing drugs it dose take time but
you must file for the Divorce FIRST.
or it will not do any good .!!!

Worry about caring for yourself and your son. Dont build a lie for him. Just let him know that she is very very sick.
