The legality of wardriving in the United States is not clearly defined. There has never been any conviction for wardriving, and there is the untested argument that the 802.11 and DHCP protocols operate on behalf of the owner giving consent to use the network, but not if the user has other reason to know that there is no consent.
A New Hampshire bill which would clarify that the duty to secure the wireless network lies with the network owner has not passed yet, due to concerns that it may create a loophole for criminal activity. The specific laws, in any case, vary from state to state. A Florida man was arrested and charged with unauthorized access to a computer network, a third-degree felony in the state of Florida, after wirelessly connecting to and hacking into a computer network.

It is'nt theft if it is free to take, many people set their unwanted furnituer at the curb hoping it will disappear. If your Neighbor's have'nt restricted thier signal then they MAY not be concerned, however, they may also be un aware. If they have broadband, then its likely that they have unlimited service and therefore are being good Neighbor's. IF they have dial-up, then they may have a time limit on thier service, and then you would be steeling because they would have to pay for overuse, and then they would end up fighting with the ISP over the service charges, not knowing that you were burning thier time alotment. Let them know that thier signal is open and Ask them if they care if you tap thier signal. I leave my signal open because I.m a GOOD NEIGHBOR and I shut-down my computer when I'm not on it. People who leave thier computers on should restrict thier signal to avoid HACKERS.

you had better secure you wireless access point before someone uses it to download child pron or goes to a terrorist website. Then the FBI will come to YOUR house and give you a full body cavity search, ask you a lot of questions, talk to everybody you know, talk to you employer and make you life a living hell until they find out that you are not dangerous, just stupid.

If the word stealing is involved... it is probably illegal. Plus, would you like it if someone was using something of yours that you pay for without them even asking?

All wireless connections have a lockout function, if they cannot be bothered to lock you out, well it is their problem!
But on the moral side, you are using their bandwidth, so morally you are stealing.
It is classed as a grey area!
