I bought an item, and the seller took forever to ship it. However, she stayed in touch with me and let me know that she had been really sick, so I told her not to worry since this is a xmas present. She says now that she shipped it just before labor day. It has still not arrived. I asked her about it and she says that if it got lost in the mail, there is nothing she can do about it since I didn't purchase any insurance. What recourse, if any, do I have?

I can feel for you!
1. Did you use Paypal? If so, you may recourse through them.
2. Buy insurance from now on.
3. Did the seller use Delivery Confirmation? It only costs $0.55 and you can enter the tracking number to see exactly where the package is.
4. Have you kept all the emails? If she says that she has been sick and took forever to ship, then says she shipped months ago, check the dates on the emails. If you have kept proof then you at least have something to take to eBay as far as disputing the transaction.

Did you pay by Paypal? Ask her to give you the tracking number and tell you how it was shipped: USPS, UPS, Fedex, DHL

Have you looked at her feedback to see if she has not delivered items before? How many negative does she have.

Did she offer you insurance.

All methods of shipping have tracking numbers. When she gives you the number you can go on line to the shipping company and track the package. It is very easy to do this from the site once you have the shipping number

If she cannot produce a shipping number then you can go on Ebay Live Help and have a chat with an Ebay representative who will advise you what to do and they may contact her.

If you paid by Paypal they will make her produce a shipping number or else they will refund your money.

You can also call Paypal. go to "contact us" on the left of your account page and keep clicking.

Also, you can call her too and discuss this with her. You can get her phone number by filling in the sellers ID and the auction number on this link

I have had a few buyers of mine claim non-delivery but I always had the tracking number and usually the package was waiting for them at the post office: there are no lost packages unless the label comes off; because undeliverable things come back to the shipper.

It doesn't matter if you bought insurance or not. It's the seller's responsibility to get your item to you. You need to file an Item Not Received report with ebay. However, you only have between 45-60 days from the end of auction to file. If it's past that time, you may be out of luck. Never let a seller string you along like that. A seller, by FTC law, has 30 days to ship an item out, 7 days to be protected by paypal if you paid through paypal.

Did you pay via paypal? If so make a complaint now and follow it through there is a timeframe (which may have passed) for their complaints process so you need to do this ASAP.

Paypal will take the money you paid to the seller and put it into a holding area, if the seller can prove that they sent your item AND you received it they will not have to pay anything however if they can't you will.

If its too late to make a claim via paypal your only hope of recourse is by going through the small claims court system.

Simply ask her for proof that the package was mailed/shipped. Surely, even without insurance, she'll have a receipt.
Take the receipt to the post office/UPS or whatever method she used and see if they can be of any help.

None,did you read ebays clauses?Its a buy at your own risk and you have no recourse unless you take the seller to small claims court.Only way for you to resolve it.

Dont recognize the place each and each guy or woman gets the belief the evidence of postage eliminates all duty onto the shopper IT DONT (there are a minimum of three dumb electorate available) Its the sellers duty to make particular the shopper gets it. so its as much as you to chase it (and it dont be counted WHAT ebay say approximately it)

If you did not buy shipping insurance then yes theres not much you can do. Make sure to check too see if she offered in her listing.

Report her to eBay. They are very strict about scammers. Tell her she either has to produce the item, or return your money, including shipping charges, else you will report her and have her taken off eBay.

Its the sellers responsiblity they legally have to find out what happened to it or reimburse you
