My husband and I ran into his old g/f "Mary" and shes saying hes the father of her child. We are waiting on a DNA test now. Being in the "best interest of the child" termination of rights may be the best way to go.
"Mary" ran off when she was pregnant and the kid is now 17 months old. While talking to her she was purposly pushing my husband's buttons and would not stop. She was trying to see what kind of reaction she could get out of him. There is NO bond between my husband and his alleged son.
If you have any idea where to find the froms to terminate parental rights please help us. I have looked online for one or an example and can't find it.

There is another man's name on the birth certificate and he has also signed a affidavid of paternity. "Mary" is running to hide from him and thinks she is going to use my husband for income so she can stay on state assistance.
And to answer the question: If "Mary" were hit by a bus would my husband want the child? No he does not want the child.

Most states won't let you terminate parental rights unless the other person is remarried and their new spouse wants to adopt the child.Children can not be left "fatherless",at least this is what my lawyer told me.Even if his rights were terminated,he is still responsible for child support unless someone else adopts the child.

Check into the abandonment laws in your state. First ask for consent to adopt from the mother. It's possible that you can adopt on the grounds of abandonment if the parent, after a period of attempt to notify of your intention to adopt, does not respond or responds in a negative manner. For me it was only a 6 month period. This was a child from a previous relationship and the father had never been a father. My husband wanted to adopt him. Worked out well.

Even if you found a form, it would have to be approved by a judge.
And it usually does NOT remove the parent's duty to provide financial support.
It just means he would have to pay & not have any visitation or other rights.
What if 'Mary' was hit by a bus?
Assuming the child is really your husbands, would he not want the right to look after the child?

Wait until the DNA testing comes back. However, unless the mother agrees, termination of parental rights will not terminate his obligation to provide financial support for this child.
