I have been seperated for 4 years now. We had a "Mediation Agreement" last Oct (2005). When his lawyer drew up the divorce papers she added several things so I didn't sign them. Nothing has been done since then. Since it's been over a year for the mediation and nothing has been done is there any legal document requiring me to allow visitation?
He doesn't pay support regularly and is stalling this divorce so I want to cut off visits in an attempt to get reg support and the divorce finalized.

I do realize that the kids deserve to see their Dad However they also deserve to receive support payments. I strongly believe child support is just that "child support". It's winter time - the kids need winter clothes, new shoes, etc. I always use the support I get on the kids only. Not trying to be selfish here. I am a stay-at-home mom of 4 and going back to school full-time in Jan. He HAS the money - he just doesn't WANT to pay.

child support is set up through the chid support division but he is THOUSANDS of dollars behind and they aren't doing anything about it.

If support has already been established and he IS NOT paying, file a Motion for Rule to Show Cause Why (insert his name) Should Not Be Held in Contempt of Court for Failure to Abide by the Court's Order of (insert date). Notice it up before a judge. Most judges will demand payment within a specified time frame. Non-compliance can result in loss of driving priviledges and/or incarceration. Again, if you can't afford an attorney, speak with the Clerk of the Court. This is something you can do without an attorney.

You need to let the court system handle the child support issues and the divorce. You do have legal options without hurting your children. If your soon to be ex. wants to spend time with your kids he should be able to regardless of if you have issues. How do you think your children will feel if their dad stops coming to see them? Do you think they will understand? Talk to your lawyer stop working with your mediator and take it through the courts.

seek legal aid and go for child support if you have to get his wages garnished so it comes out of his pay. The kids deserve to have new clothes and food on the table. You have 4 kids nobody would expect you to work with four kids so relax and enjoy them.
