By law must my employer pay me compassionate leave as I cannot afford to pay the rent if I take time off but my wife will need 24 hour care and be in pain for 3 days, I cannot afford to hire a home help? My employer only pays me minimum wage and is threatening to dock my wages and sack me if I take any more than 3 days off work. What are my rights?

UK law - your employer can pay 3 days compassionate leave, but time off for dependants is unpaid leave, although some employers do pay this.

It would be a worthwhile task to do some digging in your own organisation on this, because if you find that someone else was paid for this type of leave, then you can generally claim the payment as this is a precedent set by custom and practice. Have a look at Company policies and procedures if they exist, you have every right tot his type of information. Generally, you can take unpaid leave, or even ask to work from home if this is possible. I think your employer would find it difficult to defend itself and EMployment Tribunal...

it really depends on your company policy. many companies allow major medical leave when you have a immediate relative in need.

Also check out the information from the website listed below:
If you believe you have been illegally denied overtime pay, family or medical leave, or a minimum wage, you may wish to contact the Wage and Hour Division of the Department of Labor.

If you are in a union - any anyone on the minimum wage should be - then your union will know.
Otherwise, I think your options are limited. There is no law covering compassionate leave, it is down to the employer to decvide who can take paid leave and when.
In any case, compassionate leave usually only kicks in if there is a death in the family - close family - and this is not relevant thankfully in your present predicament.

If you live in the USA, FMLA - Family Medical Leave Act - should cover you for this. Contact the corporate HR group, or failing that your local Department of Labor about whether you qualify for FMLA.
Good luck, hope your wife is better soon.

That doesn't sound right. Ask to speak with the Human Resources Department and find out the facts. I hope your wife is doing better and has a speedy recovery!

You are entitled by law to 'family leave'. Employers often don't tell you this because they want to get away with not offering it to you. Ask them about it! It makes me laugh, all these family friendly policies workplaces are supposed to have! Where are they?
