Is that legal? I do not want my picture on the web. I'm married and don't want my pic on the web dancing with other guys even though my husband knows when I'm going out dancing but I don't want to flaunt pics. Also, sometimes I might cancel work to go out dancing and I can get in trouble with my job if pics and dates are posted. All that being said.....is it legal for someone to take your picture without your permission and put them on the internet. How can I stop that photographer??

If you are in a public place, then it's fair game.
Especially if the club has posted anywhere a disclaimer ... but even if not ... I don't think it is illegal.
Consult an attorney if you want to know absolutely for sure. (Many will give you this info for free, or a minimum amount, or consult the city attorney).

As a photographer myself, I often take photo's of people in public places, and while I usually try to take non-identifying angles, sometimes the people in them can be identified. I don't use such photo's for commercial purposes (i.e. sell the photo), but I do use them in my portfolio, my website, and have entered them in contests. When I can, I get a waiver signed by the person, but most of the time in the situations, that is not possible. Most magazines and other places won't publish or purchase a photo without a waiver ... but beyond that ... they are often not used. This is a bit of a gray area.

As people have been saying, you probably signed a model release form without realizing it. If this is the case, there is no way that you can get the photos taken down... period. He has the right to do what he wishes with them. Otherwise, these answers above are correct. When a photograph is taken, the copyright belongs to the photographer. If you are in it, he cannot do anything with the photograph commercially. But, neither can you. For this reason, ALL photographers need to put a model release form clause somewhere in their contract, or have a verbal contract with you. If you did NOT sign a release form of some sort, you could hire a lawyer. However, I would still not be surprised if you lost the case, as the copyright for a photograph IS the photographers, and having it on his website is really a relatively small use.

It is legal as long as you are in a public place and they are not using the photos towards commercial purposes or advertising. Why do you think celebrities have such a hard time with 'paparazi'? It's because of all the jerks out there who care more about what is legal or illegal than what is ethical or unethical.

If you cancel work to go dancing then you are taking the risk of your employers finding out, and that is your choice.

And regarding the suggestion to 'get a restraining order', you can't do that if he is not hassling you, or stalking you, or harming you in any way. But if he does, then I would certainly try to get one.

have you tried simply asking him nicely not to post any more of you on his site?

hummm.... Im not too sure if its legal but I think if you ask him to take them down and he refuses to then just dont go to his club no more.
