I just Got a DUI I took the breath test and it came back .077.I got arrested and taken to jail but the cop let me go and also took me home.I have to go to court it is mandatory.I was wondering what will happen to me in court and what is .077.I have had a DUI before in another state but that was over 10 years ago I now live in washington state and need to know what will happen.

that would be? 10 years ago is not counted with this new offense unless you were extreme DUI or injured someone. That is a pretty high reading. You go to jail in most states at .08. thank the cop for giving you a break and citing and releasing you. the other drunks may have puked on you.

I dont know about Washington, but in most states, you will pay a fine and do some probation if you are found guilty of DUI.

In Washington, the critical level 0.080, so you are technically under the legal limit. If you were driving irresponsibly, they could still make the charge against you.

If you can afford an attorney, you should counsel with one. He or she could protect your rights under the law.

First, be very thankful that the Officer was as generous as he/she was. They did not have to immediately release you or provide you a ride home.

Second, what happens to you depends on the laws in your state. The laws and penalties vary state to state. Here in Missouri you can be convicted of DWI even though your BAC was under .08% if it can be determined that your driving was impaired.

I'd check with an attorney in your state to find out how the laws in Washington work.
