at a Sandwich shop in my hometown.The interview went wonderfully and I easily passed the testing on the Job Application.The young lady who interviewed me told me I was hired.She went to the back to call Her Superviser .When she returned she asked me how old I was.When I told her 37 she said "sorry,we're not allowed to hire males above the age of 30"because any male aged30 or above was "probably a pervert or something"Can I sue this giant corporation and win?

You can try, but, you don't have proof, unless you taped the conversation. Isn't it illegal to ask an applicant their age?

You can contact: http://eeoc.gov/

Click on Discrimination by type: AGE and see if there is anything that indicates whether you have an age discrimination case.

Make sure you have the names of those that talked with you, at the sandwich shop.

You can also call Subway and tell them what happened.

Sounds like both age and sexual discrimination. Your problem will be getting proof that the interviewer said they're not allowed to hire males over age 30.

You mention that this is a "giant corporation." Is the store operated by the corporation or is it a franchise? Whose policy is it -- the local owner or the corporation? I doubt that it's the corporation's policy, and doubt that you could prove it was a corporate policy. But you may be able to sue the shop owner.

I wish you had a tape recorder, because it is innapropriate to accuse you of crime based simply on age. If she cited company policy, it would be a different story. Is this a franchise ? You can phone the main head office to verify the policy.
You could have been asked them the following:
Did you require a police clearance?.I can get that. I did not know it was company policy to discriminate against older applicants.
Take their names, Document the date time, and write down as much of the interview on a few sheets of paper.

Ask an attorney. Determine if this battle is really worth fighting for.

Yes. At the very least you should report this to the department in your area that handles these problems. This is discrimination and needs to be reported.

On the plus side, management is a bunch of @#@$%@%$@ and you probably would have had problems working there anyways.

Yes if you ahve proof she said that. But if it is your word against hers then it is going to be tough unless you can find others that had the same experience as you then you can file a class action lawsuit.
If not then send a letter to their HR headquarters and complain and tell them what happened, hopefully they will look into it.

The only winner will be the lawyer.
The path to permanent unemployment is the wrong attitude (like suing an employer or someone who knocked you back for a job).
Put a smile on your face and try for a job elsewhere.

If you have witnesses that will testify that your accusations are factual, than you can sue for age discrimination and libel. However, your witnesses, if any, would probably be other employees and wouldn't testify for fear of losing their jobs.

Go talk to a lawyer. If they say they are an "equal opportunity employer" then you might have a case.
