Not if the Download option is present. It is supposed to be the actual artists page and they have to make that option of whether or not they allow fans to download the music, so if you are able to click on download, the artist would have to approve that before hand. They are giving permission.
If it is a fake account, how are you really to know? The person who has uploaded the page will get in trouble, but I dont see how you would being that there is no way for you to know if that is the real artist or not.

Nay sir...it is encouraged by the musicians themselves for they are the ones offering it free for download...
