check your local state stautes but yes - if it was done without consent - charges could be pressed.

She should find another boyfriend. One without any recording equipment.
Regarding legality: Is it a criminal case or a civil case.
For example, if your girl friend is a minor (under 18) and her boy friend is 18 or more. You are clearly in the criminal case. Recording of sex activities of a minor is illegal in the United States. It constitutes child pornography and it is a crime. This is where the DA office comes into play.
If both your girl friend and her boy friend are both over 18, then this could become a civil suit.
The bottom line is your girl friend has been caught (on media) with her patties down.

Why not ? But in the court she will face a question whether she did it willingly ?
It was always better not to be up to that stage.
Sex is a crime committed by both the partners and it is adultery when they are not married.
But recording it and exploiting it is another crime

That depends on state laws. In some states if one person knows the recording is being made, it is legal. In others, it isn't. She should check with an attorney.
Also, is he still her boyfriend? If she is still with him, it is as if she consents to his behavior. If not, she should have thought before having sex with him in the first place.
And people wonder why Christians such as myself actually follow God's law and don't have sex outside of marriage. Go figure.

I'm sure there is something illegal about it - contact a lawyer immediately. Especially if your friend is under the age of eighteen.
