my nephew had a baby in feb 02 his name is on birth cert he got married in sept 02 in jan of 03 his wife left him and took the baby said she didnt love him thats the only reason,, well they are not divorced and from the time she left she wont let him or us see the baby i have not got to see her since feb 03 she was a yr old and my nephew hasnt seen her since june of 03.. i know he needs to get his divorce and get visitation rites but i cant force him thats not really the issue.. what i want to know is why is it ok for a woman who never took care of the baby to take her away from the father and person who did take care of her and not ever let him or his family see her? every time i have asked the law about it i am told that because they are still married who ever has the child in there possesion is the sole provider.. so if they were both out in a store and my nephew was to pick up his daughter and walk away with her then he would have the rite to keep her away from her mom..

this just doesnt seem rite to me why make a child do with out a parent because they are to stuborn or what ever to get a divorce? in a world where it is preached that family is so important y are we not promoting that? shouldnt they have to swith visitation anyway?? srry so long but i am highly upset about this this child was kind of like my grandbaby as i raised my nephew and i was there when she was born and i took care of her alot and now i dont even know what she looks like and it tears me up that i cant do anything about it

how would i be getting him into trouble??? i have not done anything except a few times when this first happened i called the mom to see if i could see the baby thats all i planned on doing

no he is not on drugs or drinking he was a great dad.she was not so great no drinking or drugs either but she is a player and a controler always like to see what she could make him do... anyway this is what kind of mom she is she took the baby off her formula at the age of 2 months old and her blood levels dropped way down so bad that the dr said if the iron tablets didnt help they would have to do a blood transfusion on her.. rite after that is when she started to stay with her mom because my nephew threw a fit about it

btw i was not sugesting that we take her from her mom in a store if that were what i wanted we would have done that long ago i was just saying that is what the police have told us thats how they explained it to me..

It is this way , since he did not take child first ??

And it is this way since he is letting it happen, he has not filed for custody, ( his right) and the longer he waits the harder it will be. He has not filed for visitation,

It appears he dont care.

As in all custody disputes, we never hear the whole story. Does your nephew have a history of violence or drug addiction? Does she? Why did she suddenly decide that she did not love him anymore? More importantly, why hasn't he filed divorce papers and fought for custody?

Taking the child in a store like that is always wrong. It will certainly go against him if he ever wants to have visitation right. Also after all this time, his daughter will most likely confuse him with a real kidnapper. I mean, its been over 3 years since she has seen him, right?

The mother is being a witch and knows it. Not allowing her girl to see her father is cruel to say the least.

He needs to see a lawyer to process a legal seperation and get his visitation or custodial rights established, the courts are no longer in only the mother's favor, many father's are gaining custody, I know two dads who have it.

He could actually get in trouble for carrying the child out of the store and keeping her away from the mom as she may say he's not the real dad, and pending the blood test he may end up with jail time.

To answer your question of why the law is like this, it's really very simple.

It's her child. She and the father don't live together, but the child is living with her. Until one of them invites the courts to get involved, they don't.

I suggest you stay out of it before YOU get him in trouble

He needs to decide on filing for divorce or not
