my transmission does not move untill it warms to max temp and then its fine but it wont go into 3rd gear at all, so im at 4000 rpms at 70mph. do i need a transmision or is there another way out. oh yea....... my engine light and o/d light is on the o/d light flashes. please help... i really dont wanna replace a transmission, only 70,000 mile on it!

The OD light is a warning that the Computer has identified a failure in the transmission and can no longer control it.
The Check Engine light is warning you that it has identified a failure somewhere in the powertrain that will probably cause emissions to rise to a level more than 1-1/2 times the maximum allowable for this vehicle.
With both lights on, and the fact that you cannot get into high gear, it is clear that the trans needs work, and that fact causes the engine to work at a level where emissions are extreme.
I am afraid that you need to either replace the transmission or take the car to a transmission shop for diagnosis. most shops will offer some insight at no cost, but you can expect a tear-down fee if you want a complete estimate.

Dont know exactly about the transmission problem, but many "check engine lights" goes on at 65K miles so that in non -emission checking areas engines get checked anyway. get the light reset so that it will also do its normal job.

you may just have a clogged transmission filter, need a fluid change badly or have a stuck transmission valve.

Minimize use until you get into a transmision shop.
Take an older guy with you wearing grease stained blue jeans. Go soon so you can get to a few different shops.

take it in and have them scan the codes,it sounds like the trans is in limp in mode,this protects the trans when the computer see's a problem,4000 rpm at 70 with trans in limp in ,you will very likely now need a new one
