I have been separated from my ex for almost 4 years due to abuse. our first year together we went and filed taxes and he filed them as married. I don't know what i was thinking but i didn't pay attention and just signed it so we could get it done ( i hate taxes) and now we are considered married in the state of tx. unfortunately i did it again the next tax year and did not find out that we were married until i had to file financial aid for school. when we were together he said once he married me he would never let me get divorced from him and then the abuse started. i finally managed to get me and my daughter away from him and have waitied this long to find out because i was scared of what he might do even though i have moved to another state. but i want to be rid of him once and for all!!!! and now i am ready and have enough guts and self esteem to go for it. oh yeah, there is only one police report on him of abuse.

there is only one police report on him cuz we were living with his family and they knew about it and would not let me call the cops since it was "my fault" that he would hit me.

ever since i left him i have been filing on my own and head of household. hahaha i've gotten alot smarter....i'd like to think that i'm nowhere near as naive as i used to be.

You have been seperated much longer than you had to be. Just go file for divorce, nobody can contest a divorce anymore, he won't even have to be present for the divorce proceedings, go for it. You will have to pay for the divorce but its worth it.

Hi..So sorry to hear about the abuse you suffered and i'm glad to hear your out of that situation...Yes it's possible to get a divorce even if he dosen't want it..its called a contested divorce meaning one party wants it and the other is going to fight it. I'm thinking in your case you would have definite cause especially if you have documented proof of his abuse towards you. The courts don't look favorably on abuse. In the terms of the divorce you could possibly get spousal support and if there are children child support. Good luck.

Yes, you can get your divorce. First, file for legal separation and file your own taxes! You can get your divorce based on abandonment and abuse. One police report is enough. Find a battered women's shelter and ask for advice. They can probably direct you to free legal services.

I'm not a lawyer, but I believe you can get an automatic divorce after having been separated for one year or more. Make sure you have not been filing married.

Yes you can file and get one. However, it may take a little longer for it to finalize because he doesn't want it. The law will not force you to stay married if you don't want to.
