I live in an apartment where maintenace is not taken care of. When i call for something it takes 4 days for them to show up on average even if it's an emergency. I wind up having to fix it i myself or call someone who knows how to do it for me. Yesterday the toilet over flowed and caused a flood in the bathroom maintenace as usual did not show. IS there someone i can report them too they are not member of the texas apartment association. any advice would be appreciated

Try calling the Texas Housing Authority.

Just document all the times you have called maintance, who you spoke with, etc...

Also, If you cant get the apartment manager to help you, go above them and contact the owner of the apartments and/or the leasing company agent that is in charge of the leasing agent at your apartment complex and speak with them in reguards to the repairs not getting done.

if the toilet overflowed YOU should have had a plunger on hand, in 99% of the cases for overflow all it takes is a plunger to solve it, or else stop putting a lot of paper in there, or flush more often.
Thre are only certain things apartment buildings must provide, and maybe they felt you should have plunged the potty. If you turn in this place they probably will make it tough on you.

Anyway, take a look at your lease and look for loopholes. Sometimes it gives you a way out, like paying the balance owed and giving 30 days notice. Sometimes if you get a transfer out of town for your job you can get out of a lease. Sometimes if you decide to leave maybe you can have someone come in who wants to rent the place so the owner won't lose any money. But it's better to wait out the lease. When people get their first lease on an apartment usually they take the smallest amount of rental time so that they can change their mind within that short time, remember that for your next move. If you've been a non-complainer and relinquish your deposit, and have kept the place clean and return to them your keys, etc. they might let you go. Contracts are just that, a contract. If youv'e defaulted right after you sign a lease or near the end of your lease or have been there a long time then they might be reasonable with you. Otherwise you would owe the balance if you defaulted. Why not just learn how to take care of things till they get there to fix it? You can't change owners, however you can be more choosey next time.

Re read your lease to see if it says anything about the maintenace issues, and enforce what they already made in writing by bringing it to thier attention or just fix the problem and take it out of your rent, but make sure to send the reciept. There are Landlord/Tennant rights, I would look them up for you state, call the Deaprtment of health, also if your lease staes that is you give written notice of ___ days then your term would be ended early, you could use that, Try not to get eveicted, they could take you to court and get a lot from you, by saying you damaged the property and you'll owe back rent, plus finding another place to live with a bad referance isnt as easy to do, as if you left with your rent current.

Search renters rights on the web. It does list your rights as a renter by each state. Even if he doesn't belong to the association he still has laws he has to abide by. Also in your original lease does it mention anything about repairs, who's responsible, & who pays the cost along with a time frame for repairs when needed. I have leased before & all of the above was covered in my lease. I feel sorry for you. It is a problem especially if the landlord wants the money, but doesn't want to spend any on repairs. if oj can get away with murder you can get out of your lease. get a lawyer and ask him the same question, answer his and sit back and watch them get screwed. the maintance guy is there for you.In your contract or somewhere theyve stated what the apartment consists of... ( one bath ) two/one rooms... if something is wrong with bath or the room that wasnt there prior to you signing should be fixed because you signed the contract when all these things were working. good luck
