The legal definition of "next of kin" does not include one's spouse. It includes your children, your parents, and other blood relatives who have a right of inheritance. A spouse has a right of inheritance, but is technically not a "next of kin" as they are (hopefully, lol) not a blood relative.

Blood bond includes people who are adopted. Your adopted child, adopted sibling or the parents of your adopted mother or father are still considered blood relatives under the law, even though it is medically false.

If you are talking about the common useage in terms of who gets to make decisions and notification procedures, it would be in applicable order of: your legal guardian, your spouse, your adult children, your parents, your siblings, your grandparents, your cousins and blood aunts and blood uncles (not aunts and uncles by marriage), and your nieces and nephews and anyone else surviving (second cousins, great-whatevers, etc) who has a blood bond with you.

Then come the people who have an emotional bond with you, such as a fiance or the mother or father of your minor children.

Mothers and fathers share next of kin equally, and for notification purposes the custodial parent or the parent who has been awarded physical custody in cases of joint legal custody would be considered the first next of kin with the other parent being second.

For parents who have no such legal agreements in place or for parents who are married, there is no difference in the standing of the mother or father. They are equal, and it comes down to a matter of who was home or answers the phone versus who wasn't or didn't.

It is an and/or situation, such as brother and/or sister, daughter and/or son. One does not trump the other.

If your parents are still married and living together and you are not married. Then both of them share equally in the next of kin. If your parent are divorced and no longer living together, then you have to pick who will be the next of kin. Now sometimes if something happens to you and you are unable to respond to paramedics and can not give permission for things to be done for you, then they police and hospital will try to get a hold of both parents regardless of the marital situation so they can do what needs to be done to help you.

Is my oldest sister automatically mums next of kin now she's died. Can she make all the funeral arrangements herself with out any of the other three children having a say

we are not married but I have two kids now 30 and 33 which I am not in touch with. who is my next of kin.

Mother is a child next of kin legally.

Both parents if they are still married and you are a minor.
Whichever has primary custody if they are divorce and you are a minor. Though that can change according to different state laws and custody rules listed in the divorce settlement.
If you are married it is your spouse. Even if both parents are still living.

If you're married it's the wife/husband, then your kids. If not it's your parents, mother/father then any siblings you might have and so on down the line.

You can of course choose anyone in a living will who it can be.

The person you feel closest to, could be your wife, sister, girlfriend, son, daughter, husband whatever, someone you can trust anyway!! not many , it's your choice. X

You can name who you would like to be noted as your next of kin, it doesn't even have to be family.

Its the first person you would want to be contacted on your behalf if you were ever in an accident.
If you want your dad to be at your aid then him or your mother than her.
If you don't have either than the next closes person/relative you have to you, a husband/wife or best friend

Its your closet parent or relative. I have no parents and im not married, even though i have a partner of 8yrs but im not married so therefore my eldest son is my next of kin.
