my baby's father is tryna take away my son. he didnt want to claim him now he wants to take him. and i can't let him because he's deals drugs and i dont want my baby exposed to that kinda stuff. since im only 16 and he's 18, and i take him to court, will the judge give him custody since he's 18 and im underage?

I take it you're in the USA. Here in England and in Europe, and I have no doubt in the USA too, the courts always look at what is in the best interest of the child so I have no doubt the court will award you custody of your baby. The court will take all circumatansce into considereration INCLUSING THE FACT THAT HE DEALS IN DRUGS !! I am a lawyer and if I were the judge in your case I would award you FULL custody without second thought.

If you are not married then you have sole parental rights, and as he is dealing in drugs, the court would never give custody to him,the worst you can expect is that he is given visiting rights.

He has to prove you are an unfit mother and if that can not be proven in the court of law then the mother has all the legal say so of what can be done with the child.
