Does the child want to bankrupt his/her parents with more attorney fees? This seems very plausible case but much like cutting off your nose to spite your face. Ultimately everyone would be a financial loser.
Suing for emotional distress might be a worthwhile therapeutic process for some in a very dysfunctional situation, but funds lost will lend to more funds lost AND the child may get written out of everyone's wills.

I wish...my dad was an idiot and threw away his family for some dumb bimbo when I was 6. I still ahve a lot of issues from this and I'm 21 now. He is a loser and needs to be punished for deserting his family. He also hasn't paid child support...and I grew up on ramon noodles. I think that infedelity is considered a crime in some states (there are laws that state you cannot have sex with anyone other than your spouse) and it did cause emotional damage to the child. I would wait until you are an adult (18+) get a good lawyer and sue away...I'm sure someone on a jury would see your side as 50% of all marriages end in divorce...

this is frickin america. you can sue anybody for anything. rember this guy.... he broke into someones house trying to steel something. braking and frickin entering. this moron was able to sue the house owners insurance, for get this. while braking and entering, blantently against the law, he fell on a knife. he broke into the house,,, he fell on a knife, he nearly died; or at least exteremly injured, while the owners were asleep. and he sued them.....
sue in civil court, not criminal. they did not commit a crim, so its civil. rember oj (weather he did or did not do it is beside the point), he was inicoent by the criminal court, and guilty by the civil court. paid lots and lots of money. but didnt go to jail.

inheritance is not a birthright
if they left no will it would go to probate and estate taxes and then divided amony hiers ( with family status given priority )
in some states the spouse can sue for alienation of affection, and it has been done in cases where another party has intervened in a marriage and the 3rd party, not the other spouse, was sucessfully sued
no one is guaranted an distress free childhood, and that's why you could not sue for distress

I dont think you have a leg to stand on. I think this is more a moral issue (sadly) than a legal issue. I too come from a broken home, and i know it is a struggle, but in the end it only makes you stronger. Just hold your head up and walk on. If you really want to take legal action though, I would seek a lawyers opinion. Call a lawyer in your state/town, and just ask them. They wont charge you to tell you yes or no. Best of luck to you!

That's ridiculous. As a child you are not entitled to anything when a parent dies. Unless it is specified in the will, a person's home, etc. become the property of the state. You get nothing.
Someone should sue you for trying to waste valuable court time. If you want money, work for it like everyone else.

Divorce if made fraudulently or there was collusion between the parties and involves infidelity could be a subject of claims by the children who sufferred from such situation.

good question! Maybe for emotional distress but not for funds lost because technically the child has no funds under the parents roof. I bet it would make an interesting case. Any law students out there?!

This is ridiculous. Kids are whiney enough brats now a days as it is. Buck up and realize that life sucks sometimes snf you don't always get what you deserve (or don't). But, if you focus on yourself and your success it will get nothing but better...

In this country, with all the ambulance chasing, money mongering lawyers, and crazy jurors who'll give anybody mega millions for any complaint.......It seems like anybody can sue anybody for anything for any amount, and get it.
