I recently bought a car from a second hand car dealer with one years warranty left from the main dealer (Renault). The car developed some electrical faults which is covered under warranty. After the main dealer looked at the car they admitted that they'd seen the car before with the same problems. The car has since been fixed apart from one fault which they're not sure they can fix.
What I need to know is, if the fault can not be fixed what rights do I have ie, money back, exchange with other vehicle etc.

As long as you can show that the electrical problem existed while the car was under factory warranty the car will have to fixed by Renault. Keep all of your paper work on the car. You will need it and be ready to fight them after the warranty expires, they (Renault) may give you some trouble. As for the one fault they say they can't fix.... oh yes they can they may have to rewire the whole faulty wiring but it can be done. Renault should do this if needed. Everything on a car can be fixed or replaced.

The only claim you will have against the used car dealer is if they refuse to get the car fixed for you. As long as they get it fixed every time something goes wrong they are doing their job.

You don't say what state you live in as the laws are different everywhere. Whatever you do get everything in writing from the dealer to Renault and keep your copies. Later on this may be needed if someone says they are no longer responsible to fix it.

An MOT is only valid the moment it is issued , as soon as you drive away you take responsibility for anything that is wrong with the car . If the dealer didn't give you a warranty then you have no legal recourse , it's called sold as seen , you bought it and now the problems are yours as well . Sorry but that's how it works . Remember this saying "let the buyer beware" , car dealers make a living selling wrecks to people like you . Join the AA and you can get a trained mechanic to check out a car before you buy it .

Trading standards are your best bet.. Renault cars are extremely unreliable once they have covered a few miles and Renault dealers are the worst that I have come across. You have a lot of rights as a consumer and the garage is obliged to make sure that your car is of merchantable quality and fit for the purpose for which you bought it.. Talk to trading standards or write to the dealer expalining that you intend to take the matter up with trading standards, this will normally do the trick if they are a respectable concern.

Under warrenty they have to fix it by law. They cannot pick and chooes which faults to fix and which to leave. If they simply cannot fix it they owe you the full money you paid or a new car.

if its still under warranty then local lemon laws should apply,they should be able to get the factory involved in the fix that has not been done

I'm not a legal expert, but it's possible that you may have grounds to reject the car/request a refund/replacement if it cannot be repaired.
