I had a crash a while ago which turned out to be my fault even though it wasnt as the person on the toher end made up a story which the insurers appeared to belive even though anyone could tell it was made up.

It was all sorted a long time ago but I was wondering how can he get away with it especially when there were witnesses to say he wasnt doing what he said. It caused me problems and just how common is this.

Also whats the best way to go and prove a story wrong even when you cant get hard evidence although it should be obvious it was all made up. The basic thing is he said he was pulling up to the side to park on a 2 lane road?

Answer 1 i think you misread the question anyway its dosent matter anymore i was just wondering about it as it was bought up the other night in conversation and has been bugging me ever since. I think its too late to do anything but I would like to know what could of been done.

Also can you even park on a dual carriageway? dont think it was a clearway though but strange place to want too

Probably quite common for people to make it up. Insurance company's will often go for the easiest option. ie the most common reason for that type of accident.

Often if the other person does something stupid or unexpected, it can still be your fault for not stopping, paying attention or leaving enough stopping distance.

e.g if you were driving behind someone on a clear road and he suddenly slammed his brakes on, there is a good chance you will run into the back of him. Technically its your fault for hitting him.

I was in collision with someone driving on the wrong side of the road, but the insurance said we were both to blame 60/40 but I still lost my no claims,

I had the same thing happen to me. It seems the insurance companies decide who's to blame and can't (or won't) be swayed from their decision.

My accident led to a 50/50 claim - so no one was to blame (or both to blame) but the other driver sued me for loss of earnings, hospital fees (even though they were NHS) and injury.

I found out that he wasn't ill, and that he'd flushed the painkillers given to him down the loo. I even found out that he had built a conservatory on his house whilst on the sick from work with apparent 'whiplash'. Luckily his neighbours were able to substantiate my findings and gave witness statements to this effect which where presented to their insurers. All in all I had seven independent witness statements proving his false claims - and the insurance company STILL paid him out £7000!!

Ludicrous.

best thing to do is to treat it as a life learning experience had similar problem recently ..guy hit me came out of side street said I went through red light I didn't but he had mate behind him who said he was witness exchanged details he looked at my name which wasn't British but I'm 10 generation Scot and said might have known a tourist that got me so angry phoned cops he drove of of probably had a drink in him ......he had no damage but I did still awaiting excess I had to pay Cretan ... still nervous every time car comes out of side street especially if its a male sorry guys but your bullies when it comes to road rage ......not all of you of course just some
