Is it legal in Texas for a franchise jewelry chain (ex. Friedmans Jewelry) to sale you a diamond that has been filled with out telling you? A few years ago, my boyfriend bought me a 1/2 ct. diamond ring from Friedmans and now we are trying to sale it to get a bigger and better ring but no one wants it because it has been filled. And what does filled mean exactly?

They should have made you aware when you bought it. It would probably be hard to prove they didn't now, unless you still have all the paperwork.

It's filling in the cracks of a diamond. You shouldn't have trouble trading in a 1/2 carat diamond so this one must be a mess if nobody wants to buy it. If you can get three independent Gemologists to write an appraisal saying the diamond is damaged and not because of anything you did Friedman's might refund your money. Don't buy anything else from them. I've heard other horror stories about them.

Problem here is that a lawsuit probably won't stand up in court. If you had gotten an appraisal right away you would have discovered the flaw and could have done something about it. But unfortunately, they could claim that your boyfriend bought it knowing there was a flaw or that the ring is not the one they gave you, or that you switched the diamond or a multitude of other things. This is a case of let the buyer beware. I would confront the store and threaten to go to the media or cause them a bad reputation if they do not correct the problem.

If you have the certification and receipt...take is back. Are you sure that your boyfriend purchased it at Friedmans Jewelry? If so, did you get the setting checked regularly and by their contract?

Being filled means it had a crack / fissure / pit that was filled to hide the defect...
You can probably sue them and they will settle to keep it from
becoming public...Of course, you are going to have to prove that
it is the same diamond they sold you and that they sold it as a
perfect non-filled diamond...

Isn't a 1/2 ct. stone enough? When will it end? Is there a woman out there that doesn't require one big enough to choke a poodle?
