Employer! The worker is just trying for a better life while the employer is looking to exploit low wage workers. If you pay lousy, and all your workers are immigrant, well, you can probably figure they're all illegal; so don't give me this "but I thought they had papers..." story.
BUT having said that...we have been tacitly giving the ok to this behaviour for 20 or 30 years, can we all of a sudden say, well, it was ok to violate the law yesterday and I know you have kids and a house and a family, but now we decided to enforce the rules so go home or go to jail??? That is not moral or ethical behavior.

I would tend to agree with you except for one thing. If the illegal worker has bogus papers so that the employer doesn't realize that he is illegal, then the employer should not be held accountable.

With today’s complicated immigration and exertions rules, an company with distant places workers could be careful to avert violating immigration and anti-discrimination rules in any respect levels of the corporate/worker relationship. subjects related to immigration and anti-discrimination rules can ensue for the period of the hiring era, the employment section, and at termination. working example, if a worker grants a non everlasting artwork authorization record from the Immigration service on the time the worker is employed, the corporate shouldn't in basic terms make a competent faith attempt to be sure the legitimacy of the record, yet additionally re-be sure the worker’s artwork authorization on the time the preliminary authorization expires.

Hmmm...This is a very interesting topic.I fell into the catagory of the employer. Not by choice or knowingly. It did become clear later.Let me tell you about it.I was a one person business start up.I was desparate for help just to clean up after a busy day.A friend from Mexico who had come on board told me he knew someone who spoke very little english who needed work. After putting a ad in the paper for help, which by the way ran $180.00 just for the week-end.I got very few calls.I hired one lady who said she needed the job.She never showed.I thought okey lets give this girl a chance.
Not only did she work hard for min. wage, she was my eyes for customers. She was quiet, helpful and willing to work hard on any day.
The man who had referred her just got his u.s. citizenship. Our place now very busy with employee additons of many races, all raved on her and said we need another one of her.By the way when we asked for her SS# ,she promptly brought me one .Now after 81/2 years employees have come and gone. She is like a family member,I gave her much deserved raises. We gave her maternity leave of 4 months on each child she had.She traveled 2 hrs by bus to get to work, yet another hour for her children. She put herself through school, for licensing of in our state. Then the IRS wrote saying she had a SS# not valid in the US.I am forced to fire her or put my business in jepordy.
Just some insight on this girl, she had been abused by her Father. She came with her her 14 year old sister. Their Mother sent them as far away as possible.
About eight months has past, she has another job.I don't know where.Time has gone and I am wandering why we have the whole issue. When I confronted her she hung her head and then brightly said maybe amsity form President Bush.We then had 911.Of course no help would come. She tried the catholic church who had been helping to get green cards. We tried lawyers none would help for less than thousands.Yet my other mexican employee said it should only cost a few hundred. The IRS never returned any of the tax collected. This is a true story.I have been perplexed over our selfish ideas. That we having been born to a free country, not because you or I paid the price, but our forefathers and soldiers in past and current wars. Are now so self absorbed, or tunnel visioned we as a society cannot or will not use our hearts as well as our heads to examine a way to be all that our country proclaims to be.
