ask for one. thats what my friend did, and the judge told him to either take the drug test or not see his daughter...he decided not to see his daughter

When I went through my divorce, the father tried to prove that I was an alcoholic and drug addict. The judge told him that recreational use of drugs / alcohol does not make one an unfit parent (and no I don't drink nor do drugs). You could ask for a drug test, but it's up to the judge's descretion whether he / she thinks one is warranted or not. If you are scared for the babies life in his care, you can ask for supervised visits but again it's up to the judge. And police reports won't help you. All that shows the judge is that you are trying to keep father and son apart and you could end up the bigger loser.

i'm pretty sure the judge will continue supervised visits, unless the father says that he does not want any visitation rights.... also, the baby is only 2 and a half months old, and i know that supervised visits only last for a couple of hours, so quantifying how long he has spent with the child in that short period, does nothing for your case.

That really depends on the court, and how much proof, of substance abuse, you have. There's an excellent chance that the court will continue with the supervised visits if you have the documentation you claim to have. Good luck!

yes- the drug test will help alot but- why would you want to keep the baby from him? do you not like him or are you just angry at him? i could understand you might feel that the baby is not safe with him but- he is his father. Fight that in court though- the drug test will help alot if it shows possitive for any substance. Good luck and take care of your baby

I dont think you have anything to worry about when I went to court all I had to do was tell the judge about my kids father's habits and they granted me supervised visits for my children and with a baby he aint responsible aint no judge in his wrong mind gonna give him any unsupervised visits anyway he cant be trusted with a newborn alone

I do not know what state your in but i would think so. Do you think he is still on drugs and if so do you have proof. this is a divorce hearing not custody, so nothing should change with the kids, why are you not asking these things of your attorney.???

If you have written documented proof of any questionable employment history, police reports, pictures (if he was ever violent toward you), or any positive drug tests...the judge will look at it all.
