A lot of people overdraft their accounts or wrote checks before they get the money into the account. If your bank covered the checks. You are going to have overdraft fees. You will have to pay the bank back or else you will go into check systems. And until you pay that crap back. Or the bank will deny the check and you will get a notice from whomever you gave the check too. You will have to pay them the amount plus what fees they charge for bad checks. You will also go into check systems until the fee is paid. You can't open another checking account (unless you got to US bank they open accounts for everyone). Now there are lot of people who have overdrawn their accounts and they don't go to jail they are just in check systems and can only have savings accounts. Now if you are writing bad checks all over the place as opposed to a mistake or things hitting the account at the wrong time (which happens) yes you can go to jail.
