Dude, that's like conventional wisdom among bureaucrats, but I don't think it's a Supreme Court decision. I mean, you can't drag someone into court without a charging instrument (warrant/ticket) and a case file, and you've got to maintain an evidence chain of custody - I'm sure there's a whole list of case law concerning such issues. But you can't avoid estate taxes just because the newspaper forgot to run Grandma's obituary.
